HolistiCal Primary Care and Advanced Nursing Services, Inc. (“HolistiCal,” “we,” “our,” or “us”) is committed to complying with California and federal laws applicable to healthcare providers, including laws governing telehealth, privacy of medical information, licensing, and patient consent.

By using our services (in-person or via telehealth), visiting our website, or otherwise engaging with HolistiCal, you agree to the terms in this Legal Notice, including all legal disclaimers & patient rights set forth below.

1. Provider & Supervision Information

• Medical services are provided by Olga Shnaider a Board-Certified Family Nurse Practitioner (FNP-BC).

• NP supervised by Dr. Boris Vaisman, MD.

• All providers are licensed under the relevant California laws and regulatory boards.

2. Telehealth Services & Consent Requirements

Under California law (including Welfare & Institutions Code § 14132.725, Business & Professions Code § 2290.5, and related regulations), the following applies:

• Patients must be physically located in California, USA at the time of any telehealth visit.

• Before the first telehealth service is delivered, we must obtain either verbal or written informed consent from you, which will be documented in your medical record.

• We will inform you of:

  1. Your right to receive services in person rather than via telehealth.

  2. Your right to withdraw consent at any time without penalty or loss of other benefits.

  3. The risks and limitations of telehealth compared to in-person visits.

  4. The availability of translation or language-access services if needed.

• For audio-only (phone) visits, additional documentation may be required to comply with California telehealth rules.

3. Medical Disclaimer & Scope of Care

• HolistiCal provides care consistent with the standard of care under California law.

• Telehealth services do not replace emergency care. For any life-threatening condition, call 911 or go to the nearest emergency department.

• No specific outcome is guaranteed. Patient compliance with medical advice, medications, follow-up appointments, and diagnostic testing is critical.

4. Privacy, Confidentiality & Data Breach Obligations

HolistiCal complies with:

• HIPAA (federal privacy law)

• California Medical Information Act (CMIA)

• California breach-notification laws

We will:

• Provide you with a Notice of Privacy Practices explaining how we use, share, and protect your information.

• Notify you without unreasonable delay in the event of any breach of your medical information, in compliance with California’s notification deadlines.

5. Licensing, Oversight & Compliance

• Care is rendered under proper supervision and in compliance with California Nurse Practitioner scope-of-practice laws.

• All records, consents, and documentation are maintained according to California and federal requirements.

6. Limitation of Liability

• HolistiCal is not liable for indirect, incidental, or consequential damages resulting from the use of our services.

• We are not responsible for outcomes caused by incomplete information, missed appointments, refusal of recommended treatment, or telehealth connection failures beyond our control.

7. Intellectual Property & Website Use

• All website content (text, images, logos, and graphics) is owned or licensed by HolistiCal and may not be copied or redistributed without written permission.

• Website educational content is for informational purposes only and does not replace professional medical care.

8. Changes to This Legal Notice

HolistiCal may update this Legal Notice from time to time to reflect changes in the law or in clinic policy. Any updates will be posted here with a new “Last Updated” date.
